Insurance and documentation
The vessel must be insured, and the owner is responsible for confirming that the policy covers operation by a licensed master captain. Documentation and/or state registration must be aboard, together with a letter appointing Captain James Lowe as the owner’s agent.
Vessel condition
The owner is responsible for presenting a vessel that is sound and seaworthy, with engines in good running order and recently serviced, working navigation electronics, and all USCG-required safety equipment aboard and in date.
A delivery may be postponed or declined where, in the captain’s judgement, the vessel is not fit to make the passage safely. That judgement is not negotiable and is exercised in the owner’s interest as much as the crew’s.
Loss or damage — hold harmless
Captain James Lowe is not responsible for normal wear and tear arising from a vessel being operated as intended, nor for the failure of a vessel, its machinery or its equipment while being operated prudently.
Nor is he responsible for loss or damage arising from vandalism, fire, theft, piracy, acts of war, actions of government or port authorities, or acts of God — including storms, wind, lightning, shoaling, and floating or partly submerged objects.
Routing
The captain reserves the right to alter course, route and schedule at any time in the interest of the safety of the vessel and her crew.
